Please read these terms and conditions (the “Terms”) carefully. By using, browsing, and/or reading the Website, you signify that you have read, understood, and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website or any of the Services immediately.
Stage61 Australia reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Stage61 Australia updates the Terms, it will use reasonable endeavors to provide you with notice of updates to the Terms. 5. Payment
All payments made in the course of your use of the Services are made using Stripe. In using the Website, the Services, or when making any payment in relation to your use of the Services, you warrant that you have read, understood, and agree to be bound by the Stripe terms and conditions which are available on their website.
You acknowledge and agree that where a request for the payment of the Services Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Services Fee.
You agree and acknowledge that Stage61 Australia can vary the Services Fee at any time.
6. Refund Policy
Stage61 Australia will only provide you with a refund of the Services Fee in the event they are unable to continue to provide the Services or if the manager of Stage61 Australia makes a decision, at its absolute discretion, that it is reasonable to do so under the circumstances (the “Refund”).
Any benefits set out in these Terms and Conditions may apply in addition to consumer’s rights under the Australian Consumer Law.
7. Copyright and Intellectual Property
The Website, the Services, and all of the related products of Stage61 Australia are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Services and compilation of the Website (including but not limited to text, graphics, logos, button icons, video images, audio clips, Website code, scripts, design elements, and interactive features) or the Services are owned or controlled for these purposes, and are reserved by Stage61 Australia or its contributors.
All trademarks, service marks, and trade names are owned, registered, and/or licensed by Stage61 Australia, who grants to you a worldwide, non-exclusive, royalty-free, revocable license whilst you are a Member to:

Nothing in the Terms limits or excludes any guarantees, warranties, representations, or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.
Subject to this clause, and to the extent permitted by law:

Use of the Website and the Services is at your own risk. Everything on the Website and the Services is provided to you “as is” and “as available” without warranty or condition of any kind. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, and any other intangible loss.
11. Competitors
If you are in the business of providing services similar to those offered by Stage61 Australia for commercial gain, whether to business or domestic users, you are considered a competitor. Competitors are prohibited from accessing or using any information or content on our application. Breaching this provision will render you fully responsible for any loss sustained by Stage61 Australia and any profits you derive from such a breach.
12. Termination of Contract
The Terms remain in effect until terminated by either party as outlined below:
Your Right to Terminate:

Not renewing your subscription before the end of the subscription period;

Providing Stage61 Australia with 14 days’ written notice of your intention to terminate;

Closing your accounts for all services used, where this option is available.
Stage61 Australia’s Right to Terminate:
Stage61 Australia may terminate the Terms at any time if:

You fail to renew your subscription at the end of the subscription period;

You breach or intend to breach any provision of the Terms;

Required by law;

Stage61 Australia deems the provision of services to you no longer commercially viable.
Subject to applicable laws, Stage61 Australia reserves the right to discontinue or cancel your membership at any time and may suspend or deny access to all or any portion of the website or services without notice if you breach any provision of the Terms or applicable law, or if your conduct impacts Stage61 Australia’s reputation or violates the rights of others.
13. Indemnity
You agree to indemnify Stage61 Australia, its affiliates, employees, agents, contributors, third-party content providers, and licensors from and against:

All actions, suits, claims, demands, liabilities, costs, expenses, loss, and damage (including legal fees on a full indemnity basis) incurred, suffered, or arising out of or in connection with your content;

14. Dispute Resolution
Compulsory Procedures:
If a dispute arises under the Terms, neither party may commence any tribunal or court proceedings unless the following procedures have been complied with (except where urgent interlocutory relief is sought):

Notice: A party claiming a dispute must give written notice to the other party detailing the nature of the dispute, the desired outcome, and the action required to settle the dispute.

Resolution: Upon receipt of the notice, the parties must:

Within 28 days, endeavor in good faith to resolve the dispute expeditiously by negotiation or other mutually agreed means;

If unresolved after 28 days, agree upon a mediator or request appointment by the Legal Aid Commissions;

Equally share the fees and reasonable expenses of the mediator and the cost of the venue;

Each party bears its own costs associated with the mediation.

Confidentiality: All communications concerning negotiations are confidential and must be treated as “without prejudice” negotiations under applicable laws of evidence.

Termination of Mediation: If 2 months elapse without resolution, either party may request the mediator to terminate the mediation, and the mediator must do so.
15. Venue and Jurisdiction
The services offered by Stage61 Australia are intended to be viewed by residents of Australia. In the event of any dispute arising out of or in relation to the website, you agree that the exclusive venue for resolving any dispute shall be in the courts of Queensland, Australia.
16. Governing Law
The Terms are governed by the laws of Queensland, Australia. Any dispute arising out of or relating to the Terms shall be governed, interpreted, and construed by the laws of Queensland, Australia, without reference to conflict of law principles.
17. Severance
If any part of these Terms is found to be void or unenforceable by a court of competent jurisdiction, that part shall be severed, and the remainder of the Terms shall remain in force.
18. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and Stage61 Australia concerning the use of the services and supersede all prior agreements.

Terms and Conditions: Enrolling in a course
1. Stage61 Australia Terms and Conditions
The following terms and conditions apply to enrichment and leisure programs at Stage61. Please note that different conditions apply to accredited courses and qualifications, which are outlined in the student handbook for those programs.
2. Student participation and obligations
By enrolling in Stage61 programs, students commit to attending all scheduled classes, except in cases of illness. In the event that a student is unable to attend class, they or their parent/guardian must notify Stage61 prior to the class. This is especially important in the lead-up to performances, where rehearsals may be affected by student absences.
3. Attitude and behaviour
Students are required to behave in a manner that supports a safe and productive learning environment. This includes listening to instructions, engaging in activities, and demonstrating courtesy and respect to fellow students and instructors. Physical or verbal abuse of students or instructors will not be tolerated in Stage61 classes.
Food, gum, and drink (other than bottled water) are not permitted in classes.
Students are encouraged to arrive on time to ensure they do not miss essential warm-ups or announcements.
Parents, guardians, and siblings of students are not permitted to stay in classes as spectators. In certain cases, where privacy issues arise or the presence of adults is found to inhibit student participation, parents/guardians may be asked to refrain from remaining in the room. Exceptions to this policy may be discussed directly with Stage61 administration.
4. personal property
Students are responsible for their personal property. Stage61 and its staff take no responsibility for any loss or damage to personal items brought to class. Students are advised not to bring toys or unnecessary items to class.
5. Public holidays
Unless otherwise stated, Stage61 classes will not be held on public holidays. No refunds or make-up classes will be provided for missed sessions due to illness or non-attendance.
No refunds will be given if a student withdraws from a Stage61 holiday program after its commencement.
6. Photography and video consent
During the course of Stage61 activities, students may be photographed or filmed as part of a class exercise, filmmaking project, performance, or for promotional purposes. By enrolling, you consent to your child or the student being photographed or filmed. These images may be used on Stage61’s website, in marketing brochures, and on social media platforms.

7. Enrolling in a course
By enrolling in a course workship or training , I commit to attending all scheduled classes.
I agree to pay all fees prior to the commencement of the course unless an alternative payment plan has been arranged with Stage61 administration (mail: info@stage61.com.au)
If I begin attending a course but withdraw midway or fail to return for the second day of training, I acknowledge that I am not entitled to a refund for the remainder of the course.
In the event that unforeseen circumstances, such as tutor illness, cause the course to be postponed, Stage61 will make reasonable

All fees must be paid in full before the commencement of the course unless a payment plan has been arranged with Stage61.
If a student withdraws from the course after the course has started, no refund will be provided.
If a student enrolls in a course but does not attend any classes, they are not entitled to a refund.
If Stage61 cancels the entire course or program, I will be entitled to a full refund
If the class is rescheduled to a new date, I will have the option to transfer to the new date or receive a partial refund for that day.
Refund will not be given in other circumstances or for change of mind, unless otherwise stated by Stage61
MODIFICATION OF TERMS AND CONDITIONS
Stage61 reserves the right to modify these terms and conditions at any time. Any changes will be communicated to students through official channels, including the Stage61 website and/or email notifications. Students are encouraged to review the terms periodically to stay informed of any updates.
By enrolling in any course with Stage61, you acknowledge and agree to the terms and conditions outlined above.
